All Praise be to Allah, prayer and peace be upon the Messenger of Allah and his family,

Fighting under Turkish forces has abounded and varied  Fatwas recently- so-called  Euphrates shield operation. And much ado, discussion over it and plaintiffs have  claimed the knowledge of the Frame of reference. Such cases should be addressed by scholars who enjoy established deduction in Islamic Sharia  sciences rather than being due to the extremists and composer as well as ignorant.

Moreover, such a Fatwa is not an individual partial case and sub-problems were decided upon by the old scholars and had been studied as cut off from their surroundings context.

 In addition, to declare that the Frame of reference of this Fatwas’ context; of today and many of its kind, is full of emerging facts; many circumstances and clues that affect the verdict or its adaptability. It will have not properly adapt adequately before studying its consequences, the balance of probabilities and the results- evils or interests.

problems of this caliber, that are currently being studied by scholars, must not only be assigned to a general Frame of reference but rather be privately assigned to the specific Frame of reference -sine qua non of this Fatwa.

Thus, the ongoing battle today in Syria has exceeded the issue of a conflict between a revolt people and an unjust regime; which used the help of his allies and masters to exterminate his people and destroy his country, but rather went beyond this to a conflict of influence and interests among the regional and international countries.

Based on aforementioned, the Syrian Muslim Council declares:

1. Fighting against ISIS and the PYD is legitimate and permissible because both of them are assailant aggressors.
2. The use of help by those who are appointed to fight and respond is legitimate as long as we proved our inability to answer assailant aggressor acts that are still continuing.
3. This military intervention whether it is an answer to our request or as an initiative of a reliable party; Turkey is a Muslim country which is also exposed to the aggression and assailants.
4. It can not be said here that Turkey drew infidel state assistance or cooperate with it and therefore may not be fighting with it because we restrict this fight to be against the assailant aggressor that we are unable to answer its actions. and we require not to disrupt the key decisive battle with the tyrannical regime, and not to commit ourselves to unacceptable obligations religiously towards any party.
5. Moreover, by using the assistance of Turkey and cooperating with them we are both protected against the greater evil -a fact which is determined by scholars that the greater evil should be avoided by the minor one when contrasted.
6. Finally, we address scholars, students, members of the communities and scientific links to fear Allah concerning our people and not to add misery to their miseries and sufferings by hasty fatwas; or not estimating the consequences of things and does not strike a balance between evil and interests or between evil and evils and both are considered criteria of Shari’a legislations.
7. We also address all our people and our fighters in specific not to abide by the extremists and composers fatwas’ as well as fools and unknowns. and to rally around the legitimate reference which represents the legitimacy of the major religious leagues in Syria that enjoy the finest and unswerving scholars.

We ask Allah to expedite relief that he, All Hearer and Ever-near.
